Introduction

This Privacy Statement (“Statement”) explains Mercedes-Benz HPC North America LLC’s (“Mercedes-Benz HPC”, “MBHPC”, “we”, “our”, or “us”) online practices regarding information received from you when you visit MBHPC’s website (“Site”). The purpose of this Statement is to provide a description of our online practices regarding the collection, use, and disclosure of personal information. We do not sell your personal information.

We collect information about you when you visit our Site.

Using Information

We may use information that we collect for various functions, which may include:

  • To send you information about promotions or other marketing material;
  • To conduct market research using aggregated data and execute authorized marketing programs, either directly or through a third party;
  • To test and evaluate the effectiveness of marketing programs, channels, and offers;
  • To improve a user’s interaction and overall digital experience;
  • To facilitate your participation in online activities;

Sharing Information

We may share information we collect with affiliated companies that are related by common ownership or control and/or our joint venture partners.   • Service Providers: We may share information with third parties to execute their services in support of the Site and our business.
  • Joint Venture Partners and Affiliates: We may share information with our joint venture partners and affiliates and within the Mercedes-Benz family of companies for analytical purposes, user preferences, and marketing in accordance with our customer privacy notices and applicable law.

We may share information we collect with nonaffiliated companies that perform marketing services on our behalf.

We may share information with other nonaffiliated companies as permitted by law, such as companies that perform services on our behalf or in response to law enforcement activity.

As part of a global company, we may share your information amongst our Mercedes-Benz affiliated companies and businesses or service providers which may be located outside your home country in order to provide you with the highest quality of products and services.

Security of Information

We maintain physical, electronic, and procedural safeguards to protect your personal information. These safeguards are designed to provide a level of security appropriate for the risk associated with the type of information to be safeguarded. Please be aware that no database, website, or digital application is guaranteed to be completely secure. Additionally, the security of your information also depends on the security of the devices and the internet service provider network used to access our Site. We encourage you to use caution in transmitting personally identifiable information and when using the internet.

Retention

Your information will be retained in accordance with our data retention policies. The retention policy that applies was determined based on business needs and legal requirements. Upon expiration of the assigned retention period, your data will be deleted or anonymized in a way that will no longer be attributable to you.

Cookies and Log Files

We use cookies and similar tools to identify your interests and particularly popular areas of our websites and use this information to improve the design of the Site and make it even more user friendly. For the same purposes, we use Google Analytics; cookies may also be there.

We collect information about all visitors to our Site in log files. The information inside the log files includes, but is not limited to, internet protocol ( IP ) addresses, type of browser, Internet Service Provider ( ISP ), operating system, browser language, date/time stamp, time spent on page and other similar information that is used in an aggregate basis to analyze trends and make improvements to the Site.

We do not respond to browser "do not track" signals at this time.

Third Party Sites and Social Media

It is important to know that our Site may contain links to third party sites not controlled by MBHPC or covered by this Statement. We recommend that you check the privacy statements of other sites you visit before providing personal information.

We also provide experiences through social media platforms such as Facebook, X, Instagram, LinkedIn, and YouTube. Any information you share publicly on these or other social media platforms is visible to any visitor to these platforms. Refer to each social media platform for their terms of use and privacy policies.

You should use caution when deciding to disclose personal information in these areas.

Information Collected From Third Parties

We also obtain information about the traffic and usage of the Site from third parties, including Google. These third parties also use cookies and other tracking technologies to capture information about your online interactions with us. We do not have control over the information that is collected, used, and shared by these third parties. We encourage you to review the privacy statements of these third parties to understand their privacy practices.

We would like to tailor the content of our Site as precisely as possible to your interests. In order to identify usage preferences and particularly popular areas of the websites, we use Google Analytics tools. Google Analytics Demographics & Interest Reporting (a subset of Google Analytics Advertising features) has been enabled to better understand the types of visitors to the Site. Children's Privacy

We do not intend our Site for use by anyone under the age of thirteen (13). We request that anyone under the age of thirteen (13) not submit any information to MBHPC through use of our Site.

The following disclosures are made pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (together the “CCPA”). This supplements any other privacy notices provided MBHPC. It applies solely to residents of California.

The below points reflect the categories of personal information we have collected from California consumers over the past twelve months, the categories of sources from which the information was collected, the business or commercial purpose for which the information was collected, and the categories of third parties with whom we have shared that information.

We retain the personal information we collect for as long as reasonably necessary to achieve the purposes disclosed at the point of collection or in this Statement, unless a shorter retention period is required by law. The length of retention may vary depending upon factors such as:

  • Supporting the operation and improvement of our business; and
  • The need to resolve inquiries or complaints.

The CCPA defines the “sale” of information broadly and some of our personal information disclosures may be considered a “sale” under this definition. Some of our disclosures may constitute a “sharing” where we disclose information for targeted advertising purposes. Below we have listed the categories of personal information we have disclosed to marketing partners in a way that may be considered a “sale” or “share” for CCPA purposes:

We do not “sell” or “share” sensitive personal information and we do not knowingly “sell” or “share” the personal information of minors under 16 years of age.

We otherwise use and disclose sensitive personal information only for those purposes expressly permitted under California law.

Your California Privacy Rights

California residents may have the rights listed below with respect to their personal information, subject to applicable exceptions. Please note that some of these rights may not apply to you.

  • Right to Know and Access. Exercising Your Rights

To exercise the rights to know and access, delete, correct, or limit use of sensitive personal information, please submit a verifiable consumer request to us by either:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

In order to respond to your request, we will need to verify your identity by asking you for certain personal information to match with the information we have on file. We may request that you provide us with a description of the information we require to address your rights request, including your name, email address, phone number and the nature of your request. The personal information that we use to verify your identity will not be used for any other purpose. We cannot effectuate your request if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

We do not discriminate against California residents who exercise their CCPA privacy rights.
