Privacy Statement

1. Introduction

This Privacy Statement (“Statement“) explains Mercedes-Benz HPC North America LLC’s (“Mercedes-Benz HPC“, “MBHPC“, “we“, “our“, or “us“) practices regarding information received from you when you (a) visit MBHPC’s website at www.mercedesbenzhpc.com (“Site”), or use other online services, or (b) use any EV charging services (the “Charging Services”), including any charging stations within the MBHPC charging network, along with associated digital and energy products & services, built, owned and operated by MBHPC (together the Site and the Charging Services are referred to herein as the “Services”). The purpose of this Statement is to provide you with a description of our practices regarding the collection, use, and disclosure of Personal Information. We do not sell your Personal Information. By providing us with Personal Information and/or otherwise interacting with us, you agree that your Personal Information will be processed in accordance with this Statement.

As used herein, “Personal Information” means any information that identifies or relates to a particular individual and includes information referred to as “personally identifiable information” or “personal data” under applicable data privacy laws, rules or regulations.

2. Personal Information we Collect

We may collect Personal Information about you when you use the Services, including:

    • Name, address, and e-mail address
  • Payment data
    • Payment card type and last 4 digits of payment card
  • Vehicle data
    • Vehicle MAC ID and vehicle make/model
    • Vehicle charging communication protocol, including, how much voltage, amperage, power the vehicle is requesting, state of charge on the battery, any error codes transmitted by the vehicle during charging per OCPP
  • Internet or other similar network activity
    • Internet Protocol (IP) address information and/or domain
    • GEO-location of your computer, mobile device, or tablet
    • Information regarding your internet activity, including cookies (e.g. browsing history, search history, information regarding your interaction with an internet website, application, or advertisement, or other similar information). See the Cookies section below for more information on how we use cookies to collect your Personal Information.
    • Mobile carrier and/or Internet Service Provider
  • Audio-visual data
    • Videos captured through CCTV at MBHPC charging stations
  • Other Personal Information that you voluntarily choose to provide
    • Phone number, VIN, and emails, letters and/or texts that you send to us.

We may also obtain information about the traffic and usage of the Site from third parties, including Google. These third parties also use cookies and other tracking technologies to capture information about your online interactions with us. We do not have control over the information that is collected, used, and shared by these third parties. We encourage you to review the privacy statements of these third parties to understand their privacy practices.

3. How we Use Personal Information

We may use the Personal Information that you provide to us for various general business purposes, including to:

  • provide the Services to you, including creating and managing user profiles and processing billing and transactions;
  • customize or improve the Services, including testing, research, analytics, and product development;
  • send you information about promotions or other marketing material;
  • conduct market research using aggregated data and execute authorized marketing programs, either directly or through a third party;
  • test and evaluate the effectiveness of marketing programs, channels, and offers;
  • improve a user’s interaction and overall digital experience;
  • facilitate your participation in online activities;
  • provide customer service and support to you;
  • communicate with you;
  • fulfill other specific purposes for which you provide consent; and
  • any other legitimate business purpose or as required by applicable laws.

4. With Whom we Share Personal Information

We may share Personal Information we collect with our affiliated companies that are related by common ownership or control and/or our joint venture partners. We may also share your Personal Information with third parties, including:

  • Service Providers: We may use service providers to perform specific services on our behalf. As a result, these providers may process or handle your Personal Information on our behalf. These providers include:
    • Database software providers for the management and tracking of your data.
    • Hosting, technology and communication providers.
    • Analytics providers.
    • Support and customer service vendors, and outboard call center providers.
    • Hardware and software providers we use to develop and run our hardware and software.
    • Product fulfillment and delivery providers.
    • Legal and compliance consultants, such as external counsel, external auditors, or tax consultants.
    • Payment solution providers for the secure processing of payments you provide to us.
    • Third party service providers who send communications on our behalf regarding our products and Services.
    • Promotional program providers for fulfillment of promotion program and delivery of promotional services.
    • Advertising partners, including social media providers, for the delivery of targeted advertisements
    • Survey and research providers who perform studies on our behalf
  • Payment processors: Our payment processing partner Payter collects your voluntarily-provided payment card information necessary to process your payment. Please see Payter’s terms of service and privacy policy for information on its use and storage of your Personal Information.
  • Joint Venture Partners and Affiliates: We may share information with our joint venture partners and affiliates and within the Mercedes-Benz family of companies for analytical purposes, user preferences, and marketing in accordance with our customer privacy notices and applicable law.
  • Business transactions: We may share information in connection with a merger, acquisition, consolidation, change of control, or sale of all or a portion of our assets.
  • Other: We may also share your Personal Information when we are required to do so for audit purposes, by law, with your consent, or when we believe that disclosure is necessary to protect our rights or to comply with a judicial processing, court order, or legal process.

5. Cross-Border Transfers

As part of a global company, our Mercedes-Benz affiliated companies and businesses and/or service providers may be located outside your home country in order to provide you with the highest quality of products and services. As a result, when your Personal Information is used or stored in a jurisdiction other than where you are residing, it may be subject to the law of this foreign jurisdiction, including any law permitting or requiring disclosure of the information to the government, government agencies, courts and law enforcement in that jurisdiction.

6. Security of Information

We maintain physical, electronic, and procedural safeguards to protect your Personal Information. These safeguards are designed to provide a level of security appropriate for the risk associated with the type of information to be safeguarded. Please be aware that no database, website, or digital application is guaranteed to be completely secure. Additionally, the security of your information also depends on the security of the devices and the internet service provider network used to access our Site or use our Services. We encourage you to use caution in transmitting personally identifiable information and when using the internet.

7. Retention

Your Personal Information will be retained for as long as necessary to fulfill the purposes for which the information was collected, in accordance with our data retention policies. The retention policy that applies was determined based on business needs and legal requirements. Upon expiration of the assigned retention period, your data will be deleted or anonymized in a way that will no longer be attributable to you. However, we may retain your Personal Information for a longer period when required to comply with our legal, contractual, or regulatory obligations.

8. Cookies

We use cookies and similar tools to identify your interests and particularly popular areas of our Site in order to improve the design of our Services and make it even more user friendly.

A cookie is a small data file sent by a web site to a computer’s hard drive through a web browser that enables the site to recognize a visitor’s web browser and to record activities on the web site. We use cookies to recognize visitors to our Site when they visit certain other web sites to tailor advertisements that we believe would be of interest to these visitors. By using our Services, you agree to the use of cookies.

With respect to analytics cookies, we use third-party analytics services on our Site, such as those of Google Analytics. Google Analytics Demographics & Interest Reporting (a subset of Google Analytics Advertising features) has been enabled to better understand the types of visitors to the website and users of the mobile application. If you decide against the use of cookies, it is possible that not all functions of our Site will be available to you or that individual functions are only available to you to a limited extent.

We collect information about all visitors to our Site in log files. The information contained in the log files includes, but is not limited to, internet protocol (IP) addresses, type of browser, Internet Service Provider (ISP), operating system, browser language, date/time stamp, time spent on page and other similar information that is used on an aggregate basis to analyze trends and make improvements to the Site.

We do not respond to browser “do not track” signals at this time.

9. Third Party Sites and Social Media

It is important to know that our Services may contain links to third party sites not controlled by MBHPC or covered by this Statement. We recommend that you check the privacy statements of other sites you visit before providing Personal Information.

We may also provide experiences through social media platforms such as Facebook, X, Instagram, LinkedIn, and YouTube. Any information you share publicly on these or other social media platforms is visible to any visitor to these platforms. Refer to each social media platform for their terms of use and privacy policies.

You should use caution when deciding to disclose Personal Information in these areas.

10. Children’s Privacy

We do not intend our Services for use by anyone under the age of fourteen (14).  We do not knowingly collect or solicit Personal Information from children under the age of fourteen (14) through the Site. We request that anyone under the age of fourteen (14) not submit any information to MBHPC through use of our Services.

11. Changes to this Statement

  1. This Statement is current as of the Effective Date set forth above and may be amended from time to time at our sole discretion. If we make a change to this Statement, we will post the revised version on our Site with the effective date. If you use our Services after any changes to this Statement have been posted, you hereby agree to all of the changes. We recommend that you periodically review this Statement as it may be updated or revised from time to time. If we make material changes, we will take reasonable steps to notify you of those changes. Any Personal Information that we collect will be used consistently with the Statement in effect at the time of use.

The CCPA defines the “sale” of information broadly and some of our Personal Information disclosures may be considered a “sale” under this definition. Some of our disclosures may constitute a “sharing” where we disclose information for targeted advertising purposes.  Below we have listed the categories of Personal Information we have disclosed to marketing partners in a way that may be considered a “sale” or “share” for CCPA purposes:

We do not “sell” or “share” sensitive Personal Information and we do not knowingly “sell” or “share” the Personal Information of minors under 16 years of age.

We otherwise use and disclose sensitive Personal Information only for those purposes expressly permitted under California law.

California residents may have the rights listed below with respect to their Personal Information, subject to applicable exceptions. Please note that some of these rights may not apply to you.

  • Right to Know and Access. You may have the right to confirm that we have collected Personal Information about you and know what Personal Information we have collected about you, including, as applicable, the categories of Personal Information we have collected, the sources from which we collected that Personal Information, the business or commercial purposes for which we collected, sold, and shared that Personal Information, the categories of Personal Information that we sold, shared, or disclosed to third parties for business purposes, the categories of third parties to whom we sold, shared or disclosed Personal Information, and the specific pieces of Personal Information we have collected. You may be entitled to request that we disclose this to you in a portable and, to the extent technically feasible, readily usable format.
  • Right to Deletion. You may be entitled to request that we delete the Personal Information that we have collected from you. We will use commercially reasonable efforts to honor your request, in compliance with applicable laws. Please note, however, that we may need or be required to keep such information, such as for our legitimate business purposes or to comply with applicable law.
  • Right to Correct. You may request that we correct inaccurate Personal Information that we hold about you.
  • Right to Opt-Out of Sales and Sharing of Personal Information. You may be entitled to opt out of sales of your Personal Information to third parties and to opt out of the disclosure of your Personal Information to third parties for certain targeted advertising.
  • Right to Limit Use of Sensitive Personal Information. You have the right to request that we limit the use of your “Sensitive Personal Information”, as defined under California law, for only exempt purposes such as to provide the goods and services reasonably expected by the average consumer who requests such goods and services, to prevent fraud, and to verify or maintain the quality or safety of goods or services we provide.
  • Right to Non-Discrimination. You have the right not to receive discriminatory treatment if you exercise the rights conferred to you by applicable privacy law.

To exercise the rights to know and access, delete, correct, or limit use of Sensitive Personal Information, please submit a verifiable consumer request to us by either:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

In order to respond to your request, we will need to verify your identity by asking you for certain Personal Information to match with the information we have on file. We may request that you provide us with a description of the information we require to address your rights request, including your name, email address, phone number and the nature of your request. The Personal Information that we use to verify your identity will not be used for any other purpose. We cannot effectuate your request if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

To exercise your rights under the CPA, CTDPA, OCPA, TBPSA, UCPA, including the right to confirm whether or not MBHPC is processing your Personal Information, access your Personal Information, correct inaccuracies in your Personal Information, delete Personal Information provided by, or obtained about, you, obtain a copy of your Personal Information processed by us in a portable format, to correct inaccuracies in your Personal Information (including Personal Information you provided to us, Personal Information we obtained from another source, and derived data), opt out of the processing of your Personal Information for the purposes of targeted advertising, the sale of Personal Information, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you (MBHPC does not do this), or appeal the denial of a request, you may contact at MBHPC@mercedes-benz.com. In order to respond to your request, we will need to verify your identity by asking you for certain Personal Information to match with the information we have on file. We may request that you provide us with a description of the information we require to address your rights request, including your name, email address, phone number, and the nature of your request.
